FlySys application terms

Applies to released FlySys Vario mobile and desktop applications, including distributions named FlySys Desktop. These terms apply to each platform on which FlySys makes the application available, subject to that platform’s applicable licence terms.
Licence and ownership
We grant you a non-exclusive licence to install and use the application for its intended purpose on devices you own or are authorised to use, subject to the applicable store's installation rules. Ownership of our software, branding and documentation remains with the relevant rights holders. Device ownership is not transferred or restricted by this software licence.
Do not redistribute our software commercially as your own product, misrepresent its origin, remove legally required notices or use it to gain unauthorised access to another person's device. Restrictions do not prohibit acts permitted by mandatory law, including applicable interoperability rights, or permissions provided by open-source component licences. Published device-protocol documentation may be used for legitimate third-party integrations under its applicable terms; these terms do not impose an exclusive-client requirement.
Functionality and device compatibility
Connected functions require a compatible FlySys Duo and supported USB/Bluetooth hardware, operating system and firmware. Review the published requirements before installation or purchase. Some editing or preview functions may work without a connected device. Do not assume that a simulated flight or an on-screen preview is a live measurement.
The application is a device companion and supplementary display. It is not an air-traffic service, obstacle detector, emergency system or substitute for pilot training, situational awareness, official airspace information or any legally required instrument. No aviation certification is represented unless explicitly documented for the particular product and intended operation.
Safe operation
Complete pairing, configuration, calibration, tone testing and firmware installation on the ground before flying. Test that the selected sound, volume, battery and connection settings behave as intended. Sound may be muted, masked by wind or delayed; displayed data may become stale if a connection or the operating system stops updates. Do not interact with menus in a way that distracts from controlling the aircraft.
Altitude is reference-dependent and can be affected by pressure changes, sensor error and GPS accuracy. Where automatic GPS altitude correction is enabled, it can change the altitude reference and is not a guarantee of terrain or airspace clearance. Battery autonomy figures are estimates, not a promised safe flight duration. If measurements are missing or inconsistent, stop relying on them and act according to your training and independent information.
Permissions, local data and exports
Grant only the permissions needed for functions you choose. Refusing or revoking permission may disable the corresponding function without authorising unrelated data collection. Consult the separate platform privacy notice for actual processing. You control exported profiles and measurement files; maintain copies of information important to you. This does not exclude liability for loss that the law places on us.
Device settings written through the application can persist on Duo after the app disconnects. Removing the app does not reset the device. A hardware reset or settings reset can remove custom values; follow the instructions for the specific operation.
Updates and availability
Use official releases or trusted distribution channels and follow installation guidance. We may correct faults and improve the application, while preserving mandatory conformity, security and contractual duties. Voluntary development of new features for a discontinued device model ends no later than 12 months after FlySys stops selling that model and may end earlier. This does not end support for other models in a shared application and does not limit legally required security or conformity updates. We do not promise every future feature or indefinite compatibility with every operating-system version. We do not reserve an unrestricted right to remove functions supplied with a purchased device.
Material changes to contractual terms require appropriate notice and any agreement required by law. Continued access alone will not be treated as a waiver of mandatory rights. We may terminate the licence for a material breach where lawful and proportionate, with notice and an opportunity to remedy when appropriate. Termination does not extinguish statutory rights concerning purchased hardware or digital elements. You can stop using and uninstall the app at any time.
Stores and third parties
Store distribution and any store purchase remain subject to the relevant platform's terms. These provisions supplement rather than contradict mandatory Microsoft Store, Google Play or other applicable platform licence rules. Open-source licence grants and notices take precedence for their respective components. Third-party websites, services and compatible software have their own terms; this does not exclude responsibility for an integration that FlySys is legally obliged to provide.
Liability and disputes
You remain responsible for flight decisions and lawful use. FlySys remains responsible to the extent required by law for its products, software and representations. We do not exclude liability for death or personal injury where legally protected, defective-product liability, fraud, intentional misconduct, gross negligence or mandatory consumer rights. We do not disclaim all warranties merely because an app is free or distributed through a store.
Slovenian law applies subject to mandatory consumer protections and jurisdiction rights. Contact info@flysys.eu for complaints. These terms do not force consumers to bring proceedings exclusively in Slovenia or give up statutory remedies.
