1. Seller and scope

These terms apply to direct purchases through flysys.eu. Purchases from another retailer are governed by that retailer's sales contract without affecting manufacturer obligations.
A consumer is a natural person acting outside their trade or profession. Provisions specifically identified as consumer rights do not automatically extend to business purchasers. Mandatory rights always prevail. The application licence and device instructions supplement these terms but do not reduce your rights under the sales contract.
2. Product information and orders
The product page and checkout identify the model, included items, essential characteristics, required companion equipment, compatibility and delivery conditions. A compatible phone/computer, USB data cable or BLE interface may be needed for particular functions. Only the included items expressly listed are supplied. Images illustrating accessories or usage do not add those items to an order; material characteristics must match the agreed specification.
You can review and correct your order before submitting it. Submitting an order with a payment obligation is your offer to buy. The contract is concluded when FlySys confirms acceptance of the order or confirms receipt of the full payment for that order, whichever occurs first. A payment authorisation or an automated acknowledgement of an unpaid order alone is not acceptance. If we cannot fulfil the order, we notify you promptly and refund any amount owed; an accepted order remains subject to your contractual and statutory rights. We will not substitute a materially different product or increase an accepted price without your agreement.
3. Prices and payment
Checkout shows the payable total, currency, applicable taxes and shipping charges before you order. Payment methods and the time of charging are disclosed there. Additional optional charges require your agreement. Payment providers process payment details under their own terms. We do not require you to waive statutory rights to pay or receive the product.
International shipping is charged to the customer at the flat rate displayed for the selected destination before payment. For EU consumer distance sales covered by the Union One Stop Shop scheme, applicable destination VAT is charged and declared through One Stop Shop. Other sales follow the applicable tax rules.
For exports outside the EU, FlySys pays export-formality costs. Slovenian VAT is not charged where the legal conditions for export exemption are met. The customer pays destination import taxes, customs duties and import-clearance charges, except where applicable law requires FlySys to collect or pay them. Taxes or duties collected at checkout are identified and must not be charged to the customer twice. Delivery is offered only to destinations available at checkout. Where import charges cannot reasonably be calculated beforehand, we disclose that additional charges may apply; the customer is not responsible for undisclosed charges contrary to mandatory law.
International delivery may involve customs formalities. We provide accurate shipment documentation and may request information reasonably necessary for clearance. Customs delays do not automatically remove our delivery obligations or your cancellation and refund rights. If a shipment is refused or cannot clear customs, any return costs or refund adjustment must have a contractual and lawful basis; there is no automatic forfeiture of the purchase price.
Mandatory consumer rights in an applicable destination jurisdiction remain unaffected, even where they differ from the EU rules described here. Availability is limited to the destinations and intended uses stated for the product. Country-specific conditions disclosed before purchase supplement these terms only to the extent lawful.
4. Delivery and risk
We deliver to destinations offered at checkout within the agreed period. If none is agreed, statutory delivery deadlines apply. We notify you of material delays and your available options; a delay does not give us an unlimited extension. Where legally required, you may set a reasonable additional delivery period and terminate if we still fail to deliver, or terminate immediately in qualifying cases.
For consumer deliveries using a carrier offered by us, risk passes when you or your nominated recipient takes physical possession. Please report visible transport damage promptly so we can investigate; failure to report it to the driver does not remove statutory claims.
5. Launch preorders
Initial sales are preorders for later delivery, not offers of immediately available stock. The full order total is payable when you place the preorder. Estimated delivery is November 2026. If a high volume of orders delays fulfilment, delivery may be extended, but no later than 28 February 2027. These dates refer to receipt by the customer, not merely dispatch. We notify affected customers without undue delay. The estimated and latest delivery dates are disclosed before payment and recorded in the order confirmation. This arrangement does not permit indefinite extensions or reduce statutory remedies for late delivery.
You may cancel a preorder before dispatch by contacting info@flysys.eu and receive a full refund of all amounts paid for the cancelled order, including shipping, without a cancellation or payment-processing deduction. We issue the refund without undue delay and no later than 14 days after receiving the cancellation, or sooner where mandatory law requires. We use the original payment method unless you expressly agree otherwise without additional cost. This option applies to our direct preorders and supplements statutory rights. We do not impose store credit or substitute a materially different product without agreement.
The preorder price is reduced in consideration of advance payment. Using 20% VAT solely as a comparison basis, the preorder price is EUR 199 and the planned regular price after the preorder period is EUR 299, a difference of EUR 100. The underlying net prices are EUR 199 / 1.20 and EUR 299 / 1.20; checkout applies the legally applicable tax treatment and rounding. The 20% rate is not a uniform rate charged to all customers. The planned regular price is not represented as a previous selling price.
The advance-payment discount is taken into account under Article 34 of the Slovenian Consumer Protection Act (ZVPot-1). No separate advance-payment interest is payable where the qualifying reduction equals or exceeds the statutory interest amount. For the statutory comparison, the reference bank is NLB d.d., using its applicable three-month savings-deposit rate. Any mandatory entitlement not satisfied by a qualifying reduction remains payable. This provision does not create a separate investment return or limit rights arising from late delivery or refunds.
6. Withdrawal and returns
Eligible distance-sale consumers can withdraw without giving a reason as described in the accompanying Withdrawal and Returns Policy, which includes a model form. Opening normal packaging or pairing/configuring the device does not in itself cancel that right. Business purchases have no contractual change-of-mind return right unless separately agreed.
7. Conformity, repairs and guarantees
Consumers retain mandatory rights if the product is faulty, does not meet the contract or advertised characteristics, or lacks legally required digital functionality or updates. The seller is responsible for the applicable statutory period, generally at least two years after delivery in the EU, with longer local protections preserved. Contact info@flysys.eu with the problem and evidence of purchase; a specific form or original packaging is not a precondition to a valid claim.
Available remedies include free repair or replacement and, in the circumstances required by law, a price reduction or termination/refund. We bear necessary costs of a valid conformity remedy. For Slovenian consumers, statutory repair/replacement time limits and special early-failure rights apply, including the relevant 30-day rules and legally permitted extension of up to 15 days with advance reasons. This wording does not limit another country's stronger protections.
FlySys provides a 12-month manufacturer guarantee from delivery, as set out in the accompanying Guarantee Terms. This is separate from, and does not shorten, statutory conformity rights. Ordinary wear and damage actually caused by misuse are distinguished from manufacturing defects. A third-party repair, modification or missed update does not automatically cancel all rights; the nature and cause of the claimed fault matter.
Guarantee exclusions
Guarantee coverage excludes a fault only to the extent that it results from misuse or use outside documented conditions; falls, impacts, crushing or other external mechanical damage; liquid, moisture or foreign-object exposure beyond the declared protection and permitted use; unsuitable charging, power supplies or accessories; improper storage, cleaning or maintenance; excessive temperature or aggressive substances; or repairs and hardware/software modifications that caused the fault.
Normal wear and expected gradual battery-capacity loss are excluded unless attributable to a covered defect. A scratch, opened housing, third-party repair or trace of moisture alone does not cancel all coverage. Liquid ingress caused by a product defect during use within declared conditions is not excluded. A refusal must explain the inspection findings and their connection to the claimed fault, without reversing statutory burdens of proof. Mandatory conformity and other non-excludable rights remain unaffected.
8. Software and updates
We provide conformity and security updates required by law and the contract, with appropriate installation information. The required support period depends on the product and reasonable expectations; it is not automatically limited to an app-store listing period. For each model, voluntary development of new features may end earlier and will end no later than 12 months after FlySys discontinues sales of that model. This is not a promise of regular feature releases and does not limit legally required conformity or security updates, which may remain due for longer. New optional features are not promised unless included in the sale. We will not use an update to remove agreed essential functions contrary to your rights.
Install necessary updates safely on the ground. Any restriction of liability for an omitted update applies only under the legal conditions and to a fault caused solely by that omission, including proper notice and adequate installation instructions.
9. Responsibility and limitations
Use the device and applications according to the supplied safety instructions. The pilot remains responsible for flight decisions, training and compliance with aviation rules. This does not release FlySys from responsibility for defective products, misleading statements or breach of contract.
We do not exclude liability that cannot lawfully be excluded, including applicable liability for death/personal injury, defective products, fraud, intentional misconduct or gross negligence. Consumers retain mandatory remedies and recoverable damages.
For business customers only, to the extent permitted by applicable law and subject to the preceding exclusions, liability for ordinary-negligence contractual loss is limited to reasonably foreseeable direct loss up to the price paid for the affected order. Indirect commercial loss and lost profit are excluded to the extent lawful.
10. Complaints and disputes
Send complaints to info@flysys.eu with enough information to identify the order and issue. We seek to resolve complaints amicably. FlySys d.o.o. does not recognise any provider of out-of-court consumer dispute resolution as competent under the Slovenian Out-of-Court Resolution of Consumer Disputes Act (ZIsRPS). This statement does not override mandatory participation requirements applicable in another jurisdiction. Statutory dispute-resolution and court rights remain available.
Slovenian law applies, without depriving consumers of mandatory protections of their habitual residence where applicable. Nothing requires a consumer to litigate exclusively in Slovenia where they have a right to another forum.
11. Changes and records
The version supplied when the order was accepted applies to that purchase. Later website edits do not retroactively change an existing contract. We supply the accepted terms and order information in a durable form. Privacy practices are described separately and acceptance of these terms is not consent to unrelated marketing.
